VIOLATIONS PROCEDURE

April 2014 News Letter

 

To facilitate rule enforcement the Board has established the following procedures.

  1. Once a violation has been determined the individual concerned is notified in writing and requested to conform to the rules within a specified period of time.

  1. If the individual does not comply one of two courses of action is followed:

  1. If the violation is one that can be solved simply (mowing, power washing, repair of broken water occupants side of meter/sewer lines above ground on lot, the Board can hire it done and bill the individual for the cost of the service and a service charge of up to 25%.

  2. Other violations are referred to the 'Rules Violation Committee" which is comprised solely of non-board members of the corporation. The committee can impose a fine of not more than $100 per day of violation up to a maximum of $1,000.

  1. If the cost of service and service charge, or fine is not paid the Board will place a lien on the membership certificate and/or the manufactured home. The lien will include reasonable reimbursement for legal fees.

  2. If the violation is still not resolved the Board will take appropriate legal action under Florida law up to and including eviction. Florida law provides that reasonable reimbursement for taking such action shall be paid by the resident.

 

Willingness to follow the above procedures through to eviction may seem drastic on the part of the Board. It is drastic and it pains me to even write about it. However, this is the only course the Board has under our governing documents and Florida law to ensure compliance with our rules.

Without rules our park becomes a community that embraces an anything goes mentality. Some in our park are saying the Board cannot and will not enforce the rules. Rest assured your Board can and will use all means possible to enforce our rules
